Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Mind The Stops mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Kevin Wiblin, the solo developer of Mind The Stops ("we," "us," or "our").

2. Description of Service

Mind The Stops is a mobile application that allows users to manually track which London Underground stations they have visited. Users can check off stations, view their progress, and work towards visiting all stations on the network. The App optionally uses location services to suggest nearby stations for convenience, but this is not required for core functionality.

3. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this age requirement.

4. License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal mobile device solely for your personal, non-commercial use.

You may NOT:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Rent, lease, loan, sell, sublicense, or distribute the App
• Remove or alter any proprietary notices or labels on the App
• Use the App for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to any portion of the App

5. Location Services

The App optionally uses location services to suggest nearby stations for your convenience. Location access is NOT required to use the App - you can manually select and check off stations without granting location permission.

By granting location access, you consent to the collection and use of your location data as described in our Privacy Policy. You can disable location services at any time through your device settings.

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties that the App will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy of station lists or network information
• Warranties that your data will not be lost

YOU USE THE APP AT YOUR OWN RISK. We recommend backing up your data regularly as station visit records are stored only on your device.

7. User Responsibilities

You are responsible for:

• Accurately tracking which stations you have actually visited
• Maintaining awareness of your surroundings while using the App
• Complying with all applicable laws and regulations while using the App
• Backing up your data if desired (the App stores data locally on your device)
• Following all Transport for London (TfL) rules and regulations
• Using the App honestly - this is a personal tracking tool for your own records

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KEVIN WIBLIN (THE DEVELOPER OF MIND THE STOPS) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of your station visit data or progress
• Inaccurate station information
• Personal injury or property damage
• Any issues arising from your use of the London Underground
• Business interruption

This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if we have been advised of the possibility of such damage.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO USE THE APP (WHICH IS ZERO POUNDS, AS THE APP IS FREE).

9. Not Affiliated with TfL

Mind The Stops is an independent application and is NOT affiliated with, endorsed by, or connected to Transport for London (TfL) or any other transport authority. We do not have access to official TfL systems or real-time train location data.

The App uses publicly available information and your device's location services. We are not responsible for any changes to TfL services, schedules, or routes.

10. Modifications to the App

The developer reserves the right to:

• Modify, suspend, or discontinue the App at any time without notice
• Update the App to add or remove features
• Change these Terms at any time

Continued use of the App after changes constitutes acceptance of the modified Terms.

11. Termination

The developer may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.

You may terminate your use of the App at any time by uninstalling it from your device.

Upon termination, all licenses and rights granted to you will immediately cease.

12. Intellectual Property

The App and its original content, features, and functionality are owned by Kevin Wiblin and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

London Underground station names and network data are provided for informational purposes. All trademarks remain the property of their respective owners.

13. Indemnification

You agree to indemnify, defend, and hold harmless Kevin Wiblin (the developer of Mind The Stops) from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party

14. Third-Party Services

The App may contain links to third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of England and Wales.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kevin Wiblin regarding the App and supersede all prior agreements and understandings.

18. No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

19. Updates and Notifications

The developer may provide you with notices, including changes to these Terms, via email, postal mail, or postings in the App or on our website. You consent to receive communications electronically.

21. Acknowledgment

BY USING THE APP, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. YOU FURTHER ACKNOWLEDGE THAT THE APP IS A PERSONAL TRACKING TOOL FOR RECORDING YOUR STATION VISITS AND THAT YOUR DATA IS STORED LOCALLY ON YOUR DEVICE.
